Terms of Use for Nasab

These Terms of Use ("Terms") are a legal agreement between you and TappStudio ("TappStudio," "we," "us," or "our") governing your access to and use of the Nasab mobile application and related services (collectively, the "App"). By creating an account, accessing, or using Nasab, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account and act as the primary account holder for Nasab. Profiles of minors may be added to a Family Space by an adult account holder as family members, but minors may not independently register their own account or agree to these Terms.

By using Nasab, you represent that you have the legal capacity to enter into this agreement and, where you add other individuals (living or deceased) to a Family Space, that you have a good-faith basis and appropriate family authority to do so.

2. Description of the Service

Nasab is a family archive and genealogy application that allows users to:

  • Create a "Family Space" and invite relatives to join it
  • Build a family tree recording relationships across generations
  • Record and store photographs, videos, voice notes, and life events for family members
  • Maintain a chronological family timeline
  • Comment on and engage with shared family memories
  • Manage member roles and permissions within a Family Space
  • Receive notifications about family activity, birthdays, and anniversaries

Nasab may offer free and paid subscription tiers with differing features and storage allowances, as described in Section 6.

We may add, modify, or discontinue features of the App at any time, with or without notice, as we continue to develop the product.

3. Accounts and Family Spaces

3.1 Account registration

You must register using a valid email address and maintain accurate account information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

3.2 Family Spaces and roles

A Family Space is a shared environment where multiple users can view and contribute content, subject to the following roles:

  • Owner — full control, including billing, storage/subscription management, member invitations, and the ability to delete the Family Space. There is one Owner per Family Space, and ownership cannot currently be transferred to another member.
  • Member — can add family members and relationships, build the family tree, upload photos, videos, and voice notes, create memories and comments, and manage their own contributions.

Some actions — such as adding a parent or sibling connected to a member who joined the family by marriage — may require the Owner's approval before becoming visible to the rest of the Family Space. The Owner of a Family Space is responsible for managing this approval queue and ensuring members understand these Terms.

3.3 Invitations

Family Spaces are joined via invite links, QR codes, or family codes generated within the App. You are responsible for sharing invite links only with people you intend to include in your Family Space. TappStudio is not responsible for unauthorized access resulting from an invite link being shared beyond your intended recipient.

4. User Content

4.1 Ownership

You retain ownership of the photos, videos, voice notes, biographies, and other content you upload to Nasab ("User Content"). We do not claim ownership of your User Content.

4.2 License to us

By uploading User Content, you grant TappStudio a limited, non-exclusive, royalty-free, worldwide license to host, store, reproduce, and display that content solely for the purpose of operating, maintaining, and providing the App's features to you and the other members of your Family Space. This license ends when you delete the content or your account, except as reasonably necessary for backups, legal compliance, or as otherwise described in our Privacy Policy.

4.3 Shared nature of Family Space content

Content uploaded to a Family Space is, by design, visible to other members of that space according to their role. Once content is shared into a Family Space, it becomes part of that family's collective archive; if a contributing member later leaves the Family Space, their previously uploaded content generally remains part of the shared archive, consistent with Nasab's purpose, unless removed by a Family Space Owner or through a valid request under our Privacy Policy.

4.4 Your responsibility for content

You are solely responsible for the User Content you upload, including ensuring you have the right to share photographs, recordings, or biographical information about other individuals (including minors and deceased relatives). You represent that your User Content does not infringe the rights of any third party and complies with these Terms.

4.5 Content about non-users

Because Nasab allows adding family members who are not themselves registered users (including deceased relatives), you agree to act reasonably and respectfully when adding biographical information or media depicting other people, and to remove or correct such information upon a valid request as described in our Privacy Policy.

5. Acceptable Use

You agree not to:

  • Upload content that is unlawful, defamatory, obscene, harassing, or that infringes the intellectual property or privacy rights of others
  • Impersonate any person or misrepresent your relationship to a Family Space
  • Use the App to harass, stalk, or harm any individual, including other family members
  • Attempt to gain unauthorized access to another user's account or Family Space
  • Reverse-engineer, decompile, or attempt to extract source code from the App, except as permitted by law
  • Use automated means (bots, scrapers) to access or interact with the App
  • Upload malware or attempt to disrupt the App's infrastructure
  • Use the App for any purpose other than lawful, personal family archiving

We reserve the right to remove content or suspend or terminate accounts that violate these Terms.

6. Subscriptions, Storage, and Payments

6.1 Plans

Nasab currently offers a free plan and one paid subscription plan, "Nasab Heritage," which provides additional features such as expanded media types (video, voice notes), additional family tree views, and additional storage. Export formats (e.g., PDF, GEDCOM) are not currently offered on any plan but may be introduced in a future release. We may introduce additional paid plans or reconfigure plan features over time.

6.2 Storage add-ons

We do not currently offer additional storage as a standalone add-on purchase; storage allowances are tied to your subscription plan. We may introduce recurring storage add-ons in the future, in which case they would renew on the same recurring basis as your subscription unless cancelled, and this section will be updated accordingly.

6.3 Billing

All payments are processed through the Apple App Store or Google Play Store, and are subject to their respective terms and payment methods on file with those platforms. TappStudio does not directly collect or store your payment card information.

6.4 Auto-renewal and cancellation

Subscriptions and storage add-ons automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date, through your Apple ID or Google Play account settings. Refunds are subject to the policies of the applicable app store.

6.5 Non-payment

If a paid subscription lapses or is not renewed, your Family Space's access may be restricted to a read-only state reflecting your prior plan's limitations. We do not delete your family's data solely due to non-payment; your content remains stored, and full access can be restored by resubscribing.

6.6 Price changes

We may change subscription pricing from time to time. Any price changes will apply from your next billing cycle and, where required by law or app store policy, we will provide advance notice.

7. Intellectual Property

Aside from User Content, all rights, title, and interest in and to the App — including its design, branding, "Nasab" name and logo, software, and underlying technology — are owned by TappStudio or its licensors and are protected by applicable intellectual property laws. You may not use TappStudio's branding or trademarks without our prior written consent.

8. Third-Party Services

Nasab relies on third-party infrastructure providers, including Supabase (authentication and database), Google Firebase (media storage and push notifications), RevenueCat (subscription management), and the Google Places API (place/location search), as described in our Privacy Policy. Your use of the App is also subject to the applicable terms of the Apple App Store or Google Play Store through which you downloaded the App.

9. Termination

9.1 By you

You may request deletion of your account at any time through the App's settings. If you are the sole Owner of a Family Space, since ownership cannot currently be transferred to another member, you will be asked to confirm deletion of the entire Family Space before your account can be removed. Members (non-Owners) may instead leave a Family Space at any time without deleting their prior contributions, which remain part of the family's shared archive as described in our Privacy Policy.

9.2 By us

We may suspend or terminate your access to the App if you violate these Terms, misuse the service, or for any other reason at our reasonable discretion, with notice where practicable. We may also discontinue the App entirely, in which case we will make reasonable efforts to notify users in advance and provide an opportunity to export their data where feasible.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE, OR THAT DATA LOSS WILL NEVER OCCUR. WHILE WE TAKE REASONABLE STEPS TO PROTECT AND BACK UP YOUR FAMILY'S DATA, YOU ARE ENCOURAGED TO MAINTAIN YOUR OWN COPIES OF IRREPLACEABLE PHOTOS, RECORDINGS, AND DOCUMENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TAPPSTUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, MEMORIES, OR CONTENT, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot be excluded or limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless TappStudio, its officers, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the App, your User Content, or your violation of these Terms or any rights of a third party.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in India. Before initiating formal proceedings, you agree to first contact us to attempt a good-faith resolution.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes to the App, legal requirements, or our business practices. We will notify you of material changes through the App or by email, and will update the "Last updated" date above. Continued use of Nasab after changes take effect constitutes your acceptance of the revised Terms.

15. Miscellaneous

  • Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and TappStudio regarding the App.
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
  • No waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right.
  • Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
